The information provided on this website, in classes, workshops, retreats, and teacher training programs is for educational purposes only and is not intended as medical advice. Participation in any yoga practice involves inherent risks, including but not limited to physical injury. By attending classes or events, participants acknowledge these risks and agree to take full responsibility for their own health and safety.

Kablooms and its instructors are not liable for any injuries, damages, or losses that may occur during participation in any activity, whether in-person or online. Always consult a healthcare professional before beginning any new exercise program.

By using this website or attending any Kablooms offerings, you agree to these terms.

Terms & Conditions - the basics

Effective date: September 12, 2025

Welcome to Kablooms, operated by Sonya Smith, doing business as Kablooms (“Kablooms,” “we,” “us,” or “our”). These Terms & Conditions govern your access to and use of the Site and all services we provide, including in‑person classes, online/Zoom classes, workshops, retreats, teacher training programs, memberships, and digital products (collectively, the “Services”).

By accessing the Site, creating an account, or purchasing/attending any Service, you agree to be bound by these Terms. If you do not agree, do not use the Site or Services.

1) Who We Are & Contact

2) Eligibility & Accounts

  • You must be at least 18 years old (or the age of majority in your province) to purchase Services. Minors may participate only with written parental/guardian consent and, where required, supervision.

  • You are responsible for maintaining the confidentiality of your login credentials and for all activities under your account.

  • You agree to provide accurate, current, and complete information and to update it as needed.

3) Health, Wellness & Safety Notice (Important)

  • Yoga, breathwork, meditation, and physical movement carry inherent risks, including potential injury. By participating in any Service (in-person or online), you voluntarily assume all risks and agree to practice within your limits.

  • The Site and Services are for educational and informational purposes only and are not medical advice. They are not a substitute for professional medical diagnosis or treatment.

  • Consult your physician before beginning any new exercise, breathwork, or meditation program, especially if you have a medical condition, are pregnant, or have recently had surgery or injury.

  • Stop any activity that causes pain or discomfort and seek appropriate medical attention.

  • You acknowledge that instructors cannot fully assess your unique circumstances, especially in online settings, and you are responsible for your own safety.

4) Bookings, Payments & Pricing

  • Currency: Unless stated otherwise, prices are listed in Canadian Dollars (CAD) and may be subject to HST/GST and applicable fees.

  • Payment: We may process payments through Wix, Stripe, PayPal, or other third‑party processors. By purchasing, you authorize us and the processor to charge your payment method for the total amount, including taxes.

  • Accuracy: We strive for accurate pricing and availability. In the event of an error, we may cancel or adjust a booking and will notify you.

  • Chargebacks: If you initiate a chargeback without first contacting us to resolve an issue, we may suspend or terminate access to Services pending resolution.

5) Cancellations, Transfers & Refunds

Policies differ by Service. Please read the specific policy displayed during checkout or on the event/program page.

5.1 Classes & Workshops (single‑session)

  • Participant cancellations:

    • ≥ 24 hours before start: credit or refund at our discretion (less any transaction fees).

    • < 24 hours: non‑refundable.

  • No‑shows: non‑refundable.

  • KabBlooms cancellations: full refund or credit at your choice.

5.2 Memberships & Class Packs

  • Billing: Recurring memberships bill on a monthly basis (or as stated at checkout) until canceled.

  • Cancel any time before the next billing cycle to avoid future charges. We do not pro‑rate partial months unless required by law.

  • Sharing login or content violates these Terms and may result in immediate termination without refund.

5.3 Retreats (day or multi‑day)

  • Deposit: A non‑refundable deposit may be required to secure your spot (deposit amount to be included in retreat registration).

  • Participant cancellations:

    • ≥ 30 days before start: refund of amounts paid minus deposit amount written in retreat registration and any non‑recoverable vendor costs.

    • 15–29 days: 50% refund of amounts paid (minus deposit and non‑recoverables).

    • < 15 days: non‑refundable.

  • Transfers: Subject to availability and written approval, you may transfer your booking to another person who meets eligibility requirements.

  • Travel & Insurance: You are responsible for travel arrangements, visas, and adequate travel/medical insurance. We are not liable for travel disruptions or third‑party supplier issues.

  • Minimum numbers & changes: We may reschedule or cancel a retreat if minimum enrollment is not met or due to circumstances beyond our control (see Force Majeure). You’ll receive a full refund of amounts paid to us, but we are not responsible for your travel or incidental costs.

5.4 Teacher Training Programs

  • Admission & prerequisites: As listed on each program page; spaces are limited.

  • Tuition & deposits: A non‑refundable deposit secures enrollment; remaining tuition deadlines apply.

  • Attendance & completion: Completion requires meeting attendance, coursework, and assessment standards.

  • Certification: Completion does not guarantee certification or accreditation unless explicitly stated for a given program.

  • Participant cancellations:

    • ≥ 30 days before start: refund of amounts paid minus deposit and incurred costs.

    • 15–29 days: 50% refund (minus deposit/costs).

    • < 15 days or after start: non‑refundable.

  • Program changes/cancellation: We may adjust schedules, faculty, or curriculum. If we cancel before commencement, you’ll receive a full refund of tuition paid to us.

Note: The above policies are general defaults. The specific policy displayed at checkout or in your program agreement controls if it differs.

6) Online/Virtual Classes & Digital Content

  • Your purchase grants a personal, limited, non‑transferable license to access live streams and/or recordings for your own use.

  • Recording, copying, reposting, rebroadcasting, screen‑recording, or sharing our videos, PDFs, audio files, or links is strictly prohibited.

  • You agree to ensure a safe practice space and appropriate internet/device setup. We are not responsible for connectivity issues on your side.

  • For community safety, we may moderate or remove participants who behave disruptively or violate these Terms.

7) Community Conduct

We welcome everyone. To maintain a safe and supportive environment, the following are prohibited: harassment, hate speech, abusive language or behavior, unlawful activity, or interference with others’ participation. Violations may result in removal and termination without refund.

8) Intellectual Property

All content on the Site and within the Services—including text, logos, images, videos, audio, class materials, downloads, and course content—is the intellectual property of Kablooms or its licensors and is protected by copyright and other laws. Except as expressly permitted in these Terms, no license is granted. You may not copy, distribute, modify, or create derivative works without prior written consent.

9) Testimonials, Photos & Recordings

  • By submitting a review, testimonial, or feedback, you grant Kablooms a worldwide, royalty‑free license to display and use it for marketing (first name and initial only unless you authorize otherwise).

  • Some events may include photos or brief video of the class environment. You may opt out in writing or notify the instructor before the session to avoid being filmed/photographed.

10) Third‑Party Services & Links

The Site may reference or link to third‑party websites, apps, booking systems, or payment processors. These are independent from Kablooms; we are not responsible for their content, policies, or practices. Your use of third‑party services is governed by their terms.

11) Privacy

Your privacy matters. Our collection and use of personal information is described in our [Privacy Policy] (link from your site’s footer). By using the Site or Services, you consent to our data practices as outlined there.

12) Disclaimers; No Guarantees

  • The Site and Services are provided “as is” and “as available.”

  • We do not guarantee particular results or outcomes from classes, retreats, or training. Each individual’s progress varies.

  • To the fullest extent permitted by law, Kablooms disclaims all warranties, express or implied, including non‑infringement, merchantability, and fitness for a particular purpose.

13) Limitation of Liability

To the maximum extent permitted by applicable law, Kablooms, its owners, instructors, contractors, and affiliates will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or any loss of profits or data, arising from or related to your use of the Site or Services.
Where liability cannot be excluded under Ontario law, it is limited to the amount you paid for the Service giving rise to the claim.

14) Indemnity

You agree to indemnify and hold harmless Kablooms and its personnel from any claims, demands, losses, liabilities, and expenses (including legal fees) arising out of or related to: (a) your use of the Site or Services; (b) your breach of these Terms; or (c) your violation of any law or third‑party rights.

15) Force Majeure

We are not liable for delay or failure to perform due to events beyond our reasonable control, including but not limited to acts of God, public health events, closures, labor disputes, strikes, wars, terrorism, government actions, or utility/internet outages. In such cases, we may modify, reschedule, or provide credits for Services.

16) Changes to Services & Terms

We may update the Site, Services, and these Terms from time to time. Material changes will be posted on this page with an updated Effective date. Your continued use after changes constitutes acceptance.

17) Governing Law & Disputes

These Terms are governed by the laws of the Province of Ontario and Canada, without regard to conflict‑of‑laws principles. You agree to the exclusive jurisdiction and venue of the courts located in Ontario for any disputes, unless another forum is required by consumer protection law.

18) Severability; Entire Agreement; No Waiver

If any provision of these Terms is found unenforceable, the remaining provisions remain in full force. These Terms, together with any program‑specific agreements and our Privacy Policy, are the entire agreement between you and Kablooms regarding the Site and Services. Our failure to enforce any provision is not a waiver of our right to do so later.
